1. Acceptance of Terms

By accessing or using Phaethon Security ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform.

2. Description of Service

Phaethon Security operates a cybersecurity services marketplace that connects organizations with vetted security service providers. The Platform also provides compliance tracking tools, educational resources, and security guidance.

3. User Accounts

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You must notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these terms.

4. Marketplace Listings

Service providers may purchase advertising placements on the Platform.
All listings undergo automated AI content screening and may be subject to manual review.
Listings must accurately represent the services offered and comply with all applicable laws.
We reserve the right to reject, remove, or modify any listing that violates our content policies.
Prohibited content includes but is not limited to: malicious URLs, misleading claims, offensive material, illegal services (unauthorized hacking, exploit sales, DDoS-for-hire), and content unrelated to cybersecurity.

5. Payments & Refunds

Listing placements are sold at the price displayed at the time of purchase.
Payments are processed securely through Stripe. Phaethon Security does not store your payment card details.
Listing placements are valid for a period of one (1) year from the date of purchase.
Refund requests may be submitted within 14 days of purchase if your listing has not yet been published. Once a listing is published, no refunds will be issued.
Listings removed for policy violations are not eligible for refunds.

6. Intellectual Property

All content, design, and functionality of the Platform are owned by Phaethon Security and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

By submitting a listing, you grant Phaethon Security a non-exclusive, worldwide license to display your submitted content on the Platform for the duration of your listing period.

7. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. Phaethon Security does not guarantee the accuracy, completeness, or reliability of any listings or content on the Platform.

Phaethon Security does not endorse, verify, or guarantee the quality of services offered by listed providers. Users engage with service providers at their own risk and should conduct their own due diligence.

8. Limitation of Liability

To the maximum extent permitted by law, Phaethon Security shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from these terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Compliance Tools

The NIST SP 800-53 compliance tracker and AI security recommendations provided on the Platform are for informational and educational purposes only. They do not constitute professional compliance advice. Organizations should consult qualified cybersecurity professionals for compliance assessments.

10. Modifications

We may update these Terms of Service at any time. Material changes will be communicated through the Platform. Continued use after changes constitutes acceptance of the revised terms.

11. Governing Law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
